Your Social Security number is provided to third parties, such as TransUnion for credit authentication and InfoArmor for identity monitoring.
Use of the IPP in mobile devices may require GGA to determine that you are using a mobile device and may require GGA to obtain certain identifying information about your mobile device. By using a mobile device you agree that GGA may access and use such location information and other information that may identify you or your mobile device.
We may use third-party vendor tools to understand how visitors use and engage with our web site and our online products, and to understand general web site usage and trends. Welcome to the Generali Global Assistance, Inc. website (the "Site"). The Site refers to our Identity Theft Protection Services ("IDP") site, including the Identity Protection Portal ("IPP") and related products, and is provided only to assist customers in purchasing identity protection services, viewing their identity and credit information and related resources, and managing their account. The terms "we," "us," "our" and "GGA" refer to Generali Global Assistance, Inc., a New York corporation, and our affiliates. The terms "you" "your" and "Member" refer to the Primary Member and any family plan member visiting the Site. A "Primary Member" means an individual person who has purchased IDP and is duly enrolled in compliance with the terms of enrollment. A Primary Member must be at least 18 years of age to purchase IDP and a citizen or legal resident of the United States of America.
The terms, conditions and guidelines associated with use of Identity Theft Protection Services, including related products (collectively, the "Products") are provided by GGA to you through a website operated by us or through any other site or platform through which the Products are provided. Terms of use of any content (collectively "Content") available on the Site are set forth in this Terms of Service Agreement ("TOS") and the Terms and Conditions of GGA Identity Protection Products ("Terms and Conditions"). Please read this TOS and the Terms and Conditions carefully before you use the Products or the Site. By using the Products or accessing the Site you agree to abide by the terms of this TOS and by the Terms and Conditions. Use of the Products
By registering for a Product, you agree that the information you provide during the registration process, and the information you provide from time to time while using the Products, will be true, accurate and current. It is a violation of federal criminal laws to knowingly or willfully obtain information from a consumer reporting agency under false pretenses. If GGA has any reason to suspect you have provided untrue, inaccurate or non-current information it may, in its sole discretion, terminate this Agreement (or suspend, terminate, or otherwise restrict your use of and access to the Site or any part(s) of the Products) at any time, without notice.
You agree not to: use the Products in any unlawful manner or in any manner that could damage, disable, overburden, or impair the Product or interfere with any other party's use and enjoyment of the Products; harvest or collect email addresses or other contact information of other users from the Products by electronic or other means for the purposes of sending unsolicited emails or other unsolicited communications; interfere with or disrupt the Products or servers or networks connected to the Products; violate any terms which may be applicable for any particular area of the Products; violate any applicable local, state, national or international law, or any regulations having the force of law; further or promote any criminal activity or enterprise or provide instructional information about illegal activities; or obtain or attempt to access or otherwise obtain any materials or information through any means not intentionally made available or provided for through the Products. Please also note that if GGA determines at any time that you have abused or violated any of these terms, conditions and guidelines, GGA reserves the right to terminate your access to the Site and Products immediately without notice.
Personal Information Privacy.
Although no electronic security system is foolproof, we will endeavor to protect your personal information, including, but not limited to your First Name, Last Name, Address, Social Security number, Date of Birth, and other personally identifying information about you and other Members provided to GGA using methods that are consistent with industry best practices.
You authorize GGA to provide your personal information to its third party service providers and its partners (employers, affinity organizations, wholesalers, resellers and service organizations offering Products), to receive and use this information as GGA deems reasonably necessary in the course of performing Product enrollment, delivery, service and billing.
Warranty Disclaimer.
Our Products are provided as tools for protecting your personal information and identity; however, the Products do not offer a guarantee of information and identity protection. Neither you nor your family should rely on the Products as the only tool or means of protecting your personal information and identity.
Credit Services Products.
Certain Products may be contingent upon the receipt and use of your credit report. If your plan includes credit information, you will be advised of this requirement prior to enrollment for such Products. You acknowledge that by continuing to enroll in and order such Products, you are providing "written instructions" to obtain your credit report pursuant to the Fair Credit Reporting Act. Any person who knowingly and willfully obtains a consumer credit report or score/disclosure under false pretenses may face criminal prosecution. We do not directly report or provide your credit score to any third party; however, it may be used in accordance with our Privacy Policy and the terms, conditions, and policies of the credit reporting agencies involved.
Not a Credit Repair Organization or Contract.
GGA is not a credit repair organization, or similarly regulated organization under other applicable law and does not provide any form of credit repair advice or counseling. GGA offers you access to your credit report and other credit-related information Products, but we do not offer, provide, or furnish any products, or any advice, counseling, or assistance, for the express or implied purpose of improving your credit record, credit history, or credit rating. By this we mean that we do not claim we can "clean up" or "improve" your credit record, credit history, or credit rating and you acknowledge and agree that you will not purchase, use, or access any of our Products or websites for such purposes. These items (credit record, history, and rating) are based on your past or historical credit behavior, and accurate and timely adverse credit information cannot be changed.
Transaction Monitoring Limitations.
We cannot guarantee that the transaction monitoring features of our Products will identify all suspicious activity, or that suspicious activity will be timely identified or reported through the Products. You understand and agree that our monitoring of your personal information within our network and our use of certain proprietary technologies and database information are subject to certain inherent limitations, and not all potentially fraudulent transactions and/or uses of your personal information may be monitored or identified by us within the scope of our network.
Third Party Software.
In the event that the Product you are procuring includes third party software, your use of third party software may be subject to the license terms associated with such third party software. GGA expressly disclaims any liability or responsibility with respect to any third party software.
Personal Information; Authorization
By using our Products you authorize us, as needed to provide Products to you, to obtain, monitor, and compile your: (i) credit information from one or more credit reporting agencies; (ii) "non-public personal information", "personal information", and/or "highly restricted personal information" about or concerning you as defined by the Gramm-Leach-Bliley Act (15 U.S.C. sec 6801 et seq); and (iii) other personal information. By placing your order you acknowledge and agree that your access to the Products and any consumer credit information contained therein is subject to your prior written authorization and reasonable efforts on our part to verify your identity. As such, you understand and agree that by submitting your order, you are providing "written instructions" in accordance with the Fair Credit Reporting Act ("FCRA") authorizing us to obtain credit information from the personal credit report maintained by one or more of the three nationwide credit reporting agencies and you authorize us to access your personal credit information in order to provide the Products.
Authentication.
If we are unable to obtain the required Personal Information or you fail to authenticate your identity as may be required, the Products for which you have enrolled or registered from us may be limited.
Some Products allow an adult family Member to receive identity alert information about their minor children. See the Terms and Conditions for detailed information.
Product Purchase and Activation.
To activate the Products you have purchased requires that you complete the enrollment process and use the Product.
Payment.
The Products are subject to fees as designated by GGA. In such event, you must pay all applicable fees, as described on the Site in order to use the Product. All fees are in U.S. dollars unless stated otherwise on the Site. All fees are payable upon demand on a Visa, MasterCard, American Express, Discover, Diners Club credit card, by Electronic Fund Transfer (EFT) through your bank account, or by such other method as authorized by GGA in writing. GGA reserves the right to change its fees (and to institute new charges) for the Product at any time.
By providing such payment information to us or permitting such to be provided on your behalf, you represent that you are authorized to request transactions using the payment method presented. You authorize and agree to make any required payments for the Product on a timely basis. In the case of any credit or debit card payment made by you, you authorize us to: (a) submit a transaction using the information provided to us; and (b) submit automatic recurring transactions, including those on a monthly or annual basis for membership renewals, which transactions may be based on automatic updates of credit card expiration dates and replacement credit cards.
You further acknowledge and agree that, subject to our then current Member authentication procedures, only the Primary Member may authorize changes to the account, including without limitation changes to the form of payment, or to the Product including termination of membership or changes that may result in additional charges. In all cases, the Primary Member is personally responsible for any applicable state, federal, or other taxes that may be associated with the purchase of the Product unless noted otherwise and we may collect all applicable sales taxes.
All Products Require Electronic Communication.
Unless otherwise noted, our Products are internet-based and in order to access our Products you must have: an internet browser that supports 128-bit encryption; an email account and appropriate email software; a personal computer or a mobile device, operating system and connection to the internet capable of supporting the foregoing; and sufficient electronic storage capacity on your computer's hard drive or other data storage unit or a printer that is capable of printing from your browser and email software. You understand and agree that this Agreement will be entered into electronically, and that the following information ("Communications") will be provided by us to you by electronic means: this Agreement and any amendments, modifications or supplements to it; any initial, periodic or other disclosures or notices provided in connection with the Products, including without limitation our privacy policy, all regulatory disclosures, and all communications related to the Products. In furtherance of the foregoing, you expressly consent to receive all Communications regarding your membership electronically, either by e-mail or by notices posted on the Site and you agree that any requirement that a notice, disclosure, agreement, or other Communication be sent to you by us in writing is satisfied by such electronic Communication. In order to ensure your continuing access to your Product, you agree to update your email address on file whenever your email address changes. You further agree that we may send you product-related announcements periodically. For instance, if our website is temporarily suspended for maintenance, we may send you an email. Generally, you may not opt-out of these Communications, which are not promotional in nature. If you do not wish to receive them, you have the option to deactivate your account.
Text Message Alert Service Terms and Conditions
As an IDP Member you are eligible to enroll in our Text Alert Service (the "Service"), which allows you to receive important alerts via text message sent to your cellphone concerning protection of your credit and identity. The messages will be sent on behalf of your Identity Theft Protection provider and may include alerts regarding suspicious activity about your identity, your credit file, monthly status or account related information.
To elect to receive text messages via our Text Alert Service, you first must enroll in the Service by following each of these steps:

By authorizing us to send you text message alerts, you agree that in addition to alerts by text message, we may continue to send you alerts and other notifications via the email address or telephone number you provided to us or through a different method that you and we agree to in writing, until you notify us that you no longer wish to receive alerts by the method(s) you have chosen. You understand and acknowledge that the text message alerts that we send to you will not be encrypted. You should always take precautions to protect your email and any other devices you use to access or receive such alerts to safeguard against unauthorized access.
The number of text alerts we send you will vary and will depend on the kinds of alerts you elect to receive and the activity related to your account.
Text messaging rates may apply, including applicable roaming charges, depending on your cellphone provider’s plans and applicable fees, and you may be charged by your provider for text messaging and data plan fees. We do not guarantee that text messages we send will be received, or that they will be complete or timely. Member Renewal and Cancellation.
YOUR MEMBERSHIP WILL RENEW AUTOMATICALLY UNTIL CANCELLED BY YOU OR US. THE RENEWAL FEE, MANNER OF RENEWAL PAYMENT AND MANNER OF TERMINATION MEMBERSHIP IS SET FORTH IN THE PRODUCT TERMS AND CONDITIONS AND IS SUBJECT TO CHANGE.

Eligibility.
The Products and the Site are available only to individuals or entities who can form legally binding contracts under applicable law and who are employees and affiliates of entities that have entered into a subscription or service agreement with GGA. Without limiting the foregoing, use of the Products and the Site are not available to minors under the age of 13, except through family plan accounts maintained and used by a parent or legal guardian on behalf of such minors. If you do not qualify as an authorized user for any reason, you may not use the Products or the Site.
Changes to Site and Products.
GGA reserves the right to change, suspend or discontinue any aspect of the Products or the Site at any time, including the TOS, Terms and Conditions, availability of any of the Site features, delivery services, databases or Content. Such changes will be effective on the date that such changes are posted on this Site. Your use of the GGA Site following any such change constitutes your agreement to follow and be bound by the Terms of Service and the Terms and Conditions of the Site as changed. GGA may also impose limits on features or restrict access to parts of the Site.
Privacy.
GGA strives to protect the privacy of its Site users. You may review our privacy policy, which is incorporated by reference into this TOS and is available in the footer of this Site. GGA may access your accounts and records to investigate complaints or other allegations or abuse. We will not disclose the existence or occurrence of such an investigation except to appropriate governmental authorities or unless required to do so by law. Use of mobile devices may require GGA to determine that you are using a mobile device and may require GGA to obtain certain identifying information about your mobile device.

You acknowledge and agree that the Product and any GGA software used in connection with the Product ("Software") contain proprietary and confidential information that is protected by applicable copyright, intellectual property and other laws. While some images and documents in this Site or in websites linked with this website may be in the public domain, others may be protected under copyright, trademark, and other intellectual property laws of the United States and foreign countries. Such laws generally prohibit (subject to civil and criminal penalties) the unauthorized reproduction, distribution, adaptation, display, and performance of protected works. It is your obligation to comply with all applicable laws, including, where necessary, seeking the advice of counsel regarding the application of the fair use doctrine in the event of the proposed educational use of materials available on or through this Site. Applicable Laws and Waiver of Jury Trial.
Both you and GGA agree that this Site is operated by a US entity and this TOS and your use of the Site is governed by the statutes and laws of the State of Maryland, without regard to its conflicts of laws principles. GGA makes no representation that materials on the Site are appropriate or available for use in other locations, and accessing them from territories where their contents are illegal is prohibited. Those who choose to access the Site from outside the State of Maryland do so upon their own initiative and are responsible for compliance with local laws.
You consent to the exclusive jurisdiction and venue of courts in Maryland, USA and stipulate to the fairness and convenience of proceedings in such courts for all disputes arising out of or relating to the use of this Site. You agree that all claims you may have against GGA arising out of or relating to the Site shall be heard and resolved located in the state of Maryland, and you and GGA irrevocably submit to the courts located in the state of Maryland, which shall serve as the exclusive forum for the purposes of any suit, action or other proceeding, except for a suit by GGA seeking injunctive relief, which GGA may pursue in any appropriate forum. This Agreement is personal to you, and you may not assign your rights or obligations to anyone.
General Terms.
If any provision(s) of the TOS is found to be contrary to law, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties with the other provisions remaining in full force and effect. GGA's failure to exercise or enforce any right or provision of the TOS shall not constitute a waiver of such right or provision. The TOS constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. Any waiver of any provision of the TOS will be effective only if unambiguously made in writing and signed by GGA.
GGA may terminate the Products and access to this Site at any time without notice, in its sole discretion. In the event of a termination, the Assumption of Risk, Disclaimer, Limitations of Liability, Prohibited Uses, Proprietary Rights in Software, Trademarks, Copyright, Indemnity, Applicable Laws, and General Terms Sections set forth in this TOS shall survive. Users who violate this TOS may additionally incur criminal and/or civil liability. GGA may refer violators to civil or criminal authorities for prosecution, and will cooperate fully with applicable government authorities in connection with its investigations of any suspected civil or criminal violations.
Please note that if this site or these Products are provided to you through your employer, you are subject to the terms and conditions provided for in the contract between your employer and GGA, in addition to the terms listed on this Site.
Acceptance of Terms.

This website (the "Site") is owned and/or operated by Generali Global Assistance, Inc. ("GGA") and is subject to the Terms of Service, Privacy Policy, and other legal notices posted on the Site, and these Terms and Conditions, which you should read before proceeding.
GGA provides the services listed below ("the Products"), which are part of GGA's Identity Protection Program ("IDP"). The IDP Products are accessible through the GGA Identity Protection Portal ("IPP") and the Products may only be used by you in accordance with these Terms and Conditions (the "Terms").
There are different IDP programs. Please refer to the plan details in your Account Details page to be aware of the Products that are included in your IDP.
These Terms set forth the terms and conditions applicable to your use of the IDP Products as a Member, meaning that by enrolling in the IDP Program or by using any of the IDP Products (a) you as the Primary Member and each participating Member in your family agree to the Terms on behalf of yourself and all other Members and (b) all other Members agree to the Terms. By accessing the IPP, enrolling or attempting to enroll in the IDP, or using the Products you and all participating family Members acknowledge and agree that these Terms are a legally binding contract between you and GGA. Any Member who does not agree to the Terms is not authorized to use the Products.
By enrolling in the IDP Program and/or by using any of the IDP Products (a) you as the Primary Member on behalf of yourself and all other Members, and (b) each Member using any of the IDP Products represent and warrant that the information provided to the IDP is true and correct to the best of your or such Member's knowledge and belief.
Some IDP Product features may be provided through authorized third party providers and may be subject to additional terms and conditions implemented by those authorized providers.
"Primary Member" means an individual person who has purchased IDP and is duly enrolled in compliance with the terms of enrollment. A Primary Member must be at least 18 years of age to purchase IDP and a citizen or legal resident of the United States of America.
"Member" and "you" means a Primary Member, a Spouse/Domestic partner and any Dependent Children who are in compliance with the terms of enrollment in the IDP. A Member must be a citizen or a legal resident of the United States of America.
"Dependent Children" means unmarried children from the moment of birth, including natural children, stepchildren, and adopted children primarily dependent upon the Primary Member for maintenance and support, and who are under age 19 or age 25 if enrolled as a full-time student, or unmarried children regardless of age who are incapable of self-support because of a mental or physical disability. When a Dependent Children reaches age 25, he or she will no longer be eligible for services.
"Spouse" means a person who is married to the Primary Member.
"Domestic Partner" means the mentally-competent partner of a Primary Member, either of the same or the opposite sex who is at least 18 years of age and has met all of the following requirements for at least 6 months:
i) Resides with the Primary Member; and
ii) Shares financial assets and obligations with the Primary Member.
We may require proof of the Domestic Partner relationship in the form of a signed and completed affidavit of domestic partnership.
"Purchase Date" and "Effective Date" means the date when the Primary Member purchases the IDP.
"Renewal Date" means each annual anniversary of the Purchase Date.
An "Individual Plan" includes the Primary Member only.
A "Couple Plan" includes the Primary Member and the Spouse or Domestic Partner. For more detailed information regarding Couple Plans, see Section L below.
A "Family Plan" includes the Primary Member, the Spouse or Domestic Partner and up to (6) six Dependent Children. For more detailed information regarding Family Plans, see Section L below.
IMPORTANT NOTICE: AS AN IDP MEMBER YOU ARE ENTITLED TO RECEIVE ANY OF THE IDP SERVICES LISTED BELOW THAT ARE INCLUDED IN YOUR IDP PROGRAM MEMBERSHIP PLAN. IN ORDER TO USE SOME SERVICES INCLUDED IN YOUR IDP MEMBERSHIP YOU MUST FIRST ACTIVATE THE INDICATED SERVICES BY PROVIDING US OR OUR APPROVED THIRD PARTY SERVICE PROVIDERS WITH ADDITIONAL INFORMATION ABOUT YOURSELF. PROVIDING SUCH INFORMATION IS ENTIRELY OPTIONAL, BUT IF YOU CHOOSE NOT TO PROVIDE THE REQUESTED INFORMATION, SOME INCLUDED SERVICES WILL NOT BE AVAILABLE FOR YOU TO USE OR YOU MAY NOT BE ABLE TO RECEIVE ALL THE FEATURES OF INCLUDED SERVICES. ALL PERSONAL INFORMATION WE RECEIVE FROM YOU WILL BE TREATED AS CONFIDENTIAL AND WILL BE USED ONLY BY GGA AND ITS APPROVED SERVICE PROVIDERS TO HELP PROVIDE THE PRODUCT SERVICES YOU HAVE REQUESTED. FOR ADDITIONAL INFORMATION RELATING TO USE OF INFORMATION YOU PROVIDE IN CONNECTION WITH OUR PRODUCTS, PLEASE SEE OUR PRIVACY POLICY.
If your Program includes this service, GGA will attempt to help you determine if an offer or solicitation you have received is an apparent scam, is from a malicious source, or is otherwise unsafe to engage with. You will be entitled to open up to four (4) ScamAssist cases in any given calendar month.
Use of PhishBlock® and DataScrambler® software requires that you agree to the Online Data Protection Suite End User Agreement when accessing these services. We will provide you with the Online Data Protection Suite software to be installed on your PC or laptop. The Online Data Protection Suite runs on Windows operating system and is not supported on MacOS operating systems. If you have a Windows partition on your Mac, you may use the Online Data Protection Suite software.
If included in your IDP, this service provides a maximum of three (3) downloads in the Individual, Couple, and Family Plans.

The Primary Member may select to pay the IDP fee(s) on an annual basis, on a monthly basis or on a monthly with down payment basis.
If the annual payment option is selected, the annual fee is due in full at the time of purchase.
If the monthly payment option is selected, the monthly fee is due every month and will be billed automatically to your payment method (credit card or electronic fund transfers through your bank account) on record each month unless and until you cancel your membership.
If the monthly with down payment option is selected, the down payment fee is due in full at the time of purchase. The monthly fee is due every month starting from the end of the down payment period and will be billed automatically to your payment method (credit card or electronic fund transfers through your bank account) on record each month unless and until you cancel your membership.
Non-payment of the applicable fee when due will result in termination of services effective on the date the payment was due.
As a service to its Members, GGA employs technology that automatically recognizes payment card updates and allows GGA to execute payment on the updated card on file in the Primary Member’s account.
The IDP membership may be cancelled only by the Primary Member within the first thirty (30) calendar days from the Purchase Date. To cancel your IDP Program, please contact GGA by phone at the numbers provided in the upper right hand side area of the IDP website. Cancellation is effective immediately upon receipt of the telephonic request from the Primary Member (the "Cancellation Date").
IDP membership paid on a monthly basis may be cancelled prior to the end of any month during the term of the membership. To cancel your IDP Program, please contact GGA by phone at the numbers provided in the upper right hand side area of the IDP website. Cancellation of a monthly payment IDP membership is effective immediately upon receipt of the telephonic request from the Primary Member (the "Cancellation Date"), subject to the Refund Policy as set forth below.
Refunds of any payments made by the Primary Member for the IDP are subject to the IDP’s Refund Policy as set forth below.
If you have selected an annual payment, the annual fee is refundable only upon request made within the first thirty (30) calendar days from the Purchase Date (the “Refund Period”). If insurance coverage is included in your IDP Plan and there has been a covered expense on behalf of a Member during the Refund Period, then the annual fee is not refundable. Refunds will be made to the same form of payment originally provided by the Primary Member at the time of enrollment.

If insurance coverage is included in your IDP Plan and there has been a covered expense on behalf of a Member during the Refund Period, then the down payment fee is not refundable. Cancellation will stop monthly billing effective as of the first day of the next month following the Cancellation Date and Members will cease to receive services starting on the Cancellation Date. If you cancel the IDP Program after thirty (30) calendar days from the Purchase Date, you will not be entitled to any refund of payments already made to the IDP Program. If you participate in a free trial offer, unless you request to terminate your participation in the IDP Program within thirty (30) calendar days from the beginning of the free trial, you will automatically be enrolled in the IDP Program and the Primary Member’s credit card will automatically be charged the applicable amount for your IDP membership on a monthly basis. The first monthly fee is refundable only upon request made within thirty (30) calendar days from the date the first monthly fee is charged to the Primary Member’s credit card (the “Enrollment Date”). Cancellation will stop monthly billing effective as of the first day of the next month following the Cancellation Date and Members will cease to receive services starting on the Cancellation Date. If you cancel the IDP Program after thirty (30) calendar days from the Enrollment Date, you will not be entitled to any refund of payments already made to the IDP Program. Refunds will be made to the same form of payment originally provided by the Primary Member at the time of enrollment.
If you notify GGA of your intention not to renew membership at any time prior to the Renewal Date, the Program will not be renewed and no additional fee will be incurred.
The program is effective on the day of sale (the "Effective Date") and is active for one year provided that the Primary Member has paid the total amount of the applicable annual, monthly, or monthly with down payment fee. Thereafter, on each anniversary of the Effective Date (each a "Renewal Date"), the IDP will renew automatically for additional one (1) year terms unless the Primary Member gives notice of his or her intention not to renew at any time before the Renewal Date but not later than two (2) business days prior to the Renewal Date. The Primary Member must pay the total amount of the applicable annual or monthly fee, depending on which payment option the Primary Member has chosen, for each additional term. Note: If monthly with down payment was chosen initially the additional term will continue on a monthly basis. Please see Refund Policy above.
After the Initial Term, the program renews automatically for additional one (1) year terms unless the Primary Member gives notice of his or her intention not to renew before the Renewal Date. The Primary Member must pay the total amount of the applicable annual or monthly fee each additional year. Note: If monthly with down payment was the payment option chosen initially, then the monthly fee will continue to apply every month during each additional year. Please see Refund Policy above.
GGA will send a renewal notice to the Primary Member one month prior to the Renewal Date to inform him or her that the IDP membership will automatically renew for the same annual or monthly fee in the same form of payment that was originally provided unless the Primary Member provides notice of intent not to renew in accordance with the cancellation procedures set forth above at any time but no later than two (2) business days prior to the Renewal Date.
By enrolling in the IDP program and/or by using any of the services, you, as Primary Member, and each Member agree that the total and exclusive liability of GGA and its employees, officers, directors, attorneys, agents, assigns and third-party contractors (the "GGA Parties") to any Member for any claims, demands or damages relating to or arising out of IDP, the provision of services or any failure to provide services, shall be limited to the refund of the amount paid to GGA by the Member for the IDP program ("Limit of Damages"). You, as Primary Member, and each Member agree to indemnify and hold the GGA Parties harmless for all damages, costs and expenses, including reasonable attorneys' fees and costs, incurred by GGA in or relating to any legal proceeding brought by or on behalf of any Member for any claim, demand or damages in excess of the Limit of Damages. To the maximum extent permitted by law, notwithstanding any other provision of these Terms and Conditions, in no event shall GGA be liable to you or any Member for any exemplary or punitive damages, any remote or consequential damages or any damages not arising directly and proximately from the provision of services, regardless or whether or not such damages were reasonably foreseeable by GGA at the time of the provision of services or the Member's enrollment in the IDP program.
These Terms shall be deemed to be made in the State of Maryland and shall in all respects be interpreted, construed and governed by and in accordance with its laws without application of conflicts of law provisions. For any disputes arising out of the Terms, the parties irrevocably submit to the jurisdiction of the local and federal courts of the State of Maryland, which shall serve as the exclusive forum for the purposes of any suit, action or other proceeding, except for a suit by GGA seeking injunctive relief, which GGA may pursue in any appropriate forum.
Couple Plan.
The GGA Couple Plan allows the Primary Member to purchase a single membership that enables their Spouse or Domestic Partner to enjoy the Plan benefits. Although the Primary Member may pay for their Spouse or Domestic Partner to be in the Couple Plan, each Member of the Plan must separately enroll in the Plan by providing their own email address and other identifying information to access the Couple Plan benefits. Each Member will have their own login and password. Neither Member in a Couple Plan is allowed to access the personal information of the other Member and all notifications, alerts and monitoring information will be sent only to the email address provided by the individual Member at the time such Member signs up for IDP services.
Family Plan.
The GGA Family Plan allows the Primary Member to purchase a single membership that enables their Spouse or Domestic Partner to enjoy the Plan benefits In addition, the Family Plan allows the Primary Member to monitor up to six (6) of their Dependent Children by means of the "Child Monitoring" Product feature of the Plan. Information pertaining to minor Dependent Children will be associated with and viewable on the Primary Member’s account. Dependent Children between the ages of 18 -24 may be enrolled under the Family Plan only as adult Members with their own email, login and password, and their information will not be viewable by the Primary Member. When a Dependent Child reaches age 25, he or she will no longer be eligible for services.
Enrollment of Minor Children in Family Plan.
As part of your Family Plan membership, you are entitled to enroll Dependent Children. You may enroll Dependent Children under the age of 18 for whom you are the legal parent or guardian by providing required information including, but not limited to, a valid Social Security number and date of birth for each of your minor children, and supporting documentation as requested. When a Dependent Child turns 18, you will be notified to provide an email for that child and your access to the child’s information will be blocked. A Dependent Child 18 years and older must set up their own password and login to retrieve their information.
Further Certifications or Documents May Be Required.
We will provide information about a minor child only to a Primary Member who is also the minor child's parent or legal guardian. By enrolling any minor child, you must certify that each such child is under the age of eighteen (18) years of age and you are the parent or legal guardian of each minor child whom you have named on the enrollment forms. We may also require further documentation regarding your status as parent or legal guardian prior to releasing certain information to you. YOU ACKNOWLEDGE AND AGREE THAT IT IS ILLEGAL FOR ANYONE TO OBTAIN PERSONAL INFORMATION CONCERNING A MINOR CHILD FOR WHOM THEY ARE NOT THE PARENT OR LEGAL GUARDIAN AND YOU FURTHER ACKNOWLEDGE AND AGREE THAT YOUR ENROLLMENT OF YOUR MINOR CHILD REQUIRES US TO OBTAIN INFORMATION ABOUT YOUR CHILD AND THAT ANY INFORMATION ABOUT YOUR MINOR CHILD THAT YOU OBTAIN FROM US WILL BE USED SOLELY FOR THE PURPOSE OF ASSISTING YOU IN PROTECTING YOUR MINOR CHILD AGAINST ACTUAL, SUSPECTED OR POTENTIAL FRAUD.
Automatic Suspension.
When a Dependent Child turns 18, you will be notified to send a link to your child to enroll with that child’s own email, login and password under the Family Plan. On the child’s 18th birthday, your access to the child’s information will automatically cease and all Child Monitoring will automatically cease on that date. Once this occurs, you will no longer be eligible to receive monitoring of any sort regarding that child. If your Dependent Child proceeds to enroll under the Family Plan as an adult, they may continue to receive the Family Plan Product for as long as they remain an eligible Dependent Child and your Family Plan stays in effect.
